Exciting update! Texas has now authorized the provision of online notary services. This move brings Texas in line with several other states that permit their commissioned notaries public to remotely notarize signatures using two-way video and audio conferencing.

Remote Online Notarization

According to Section 406.110, Texas notaries who are authorized can now conduct online notarizations as specified in Section 406.107, regardless of whether the principal is physically present in the state during the online notarization. The amendment outlines the requirements for proper identification of the principal, as well as the acceptable forms of signature and seal for notaries public. Additionally, the amendment provides the necessary guidelines for Texas notary publics to qualify and apply for a commission for remote online notarization. Section 406.104 empowers the secretary of state to establish and maintain standards for online notarization, including protocols for credential analysis and identity verification.
